Terms of service

1. Who we are and these terms

Seek TCG is operated by Seek TCG Systems Ltd (company registration pending), registered in England and Wales, with registered office and contact address at 2 Ashcombe Road, Merstham, Surrey, RH1 3BY, United Kingdom (“Seek TCG”, “we”, “us”). Contact: hello@seektcg.com.

These terms govern the Seek TCG website, web app and iOS companion. The order summary, plan description, Refunds & cancellation policy, Privacy policy and any expressly accepted marketplace or business schedule form part of the agreement.

If you use Seek TCG mainly outside your trade, business, craft or profession, you are a consumer. If you use it mainly for those purposes, you are a business user. A profile setting is relevant but does not override your legal status. Consumer statutory rights are unaffected.

2. Pre-launch status

The current site offers a waitlist only. Product accounts and paid plans are not yet publicly available. Descriptions of future features are plans rather than a promise that a feature will launch in a particular form or on a particular date.

3. Eligibility and accounts

You must be at least 18, provide accurate information and keep your credentials secure. Tell us promptly about suspected unauthorised use. You are responsible for activity you authorise, but this does not make you responsible for a failure caused by Seek TCG’s breach, negligence or insecure operation.

If you act for an organisation, you confirm that you have authority to bind it. You must not create an account using another person’s details or transfer an account without our written agreement.

4. The service and your decisions

Seek TCG helps identify cards, record visible condition evidence, show third-party price signals, manage inventory and prepare marketplace listings. Identifications, conditions, valuations, tax prompts and recommendations are automated estimates. They may be incomplete, delayed or wrong and are not a certified grade, authenticity determination, guaranteed sale price, tax calculation or investment recommendation.

Review all information and every material listing field before acting. Keep your own copy of important records and use current official guidance or a qualified adviser for tax, legal or financial decisions. Nothing in this section limits our duty to provide a consumer service with reasonable care and skill.

5. Marketplace connections and authority

You may connect only a marketplace account you are authorised to use. Authentication must occur through the marketplace. You authorise Seek TCG to access the data and perform the specific actions shown to you within the permissions you grant.

Seek TCG will publish a listing only after displaying the material fields for review and receiving a separate, express Publish listing confirmation. Unless separately agreed and clearly enabled, Seek TCG will not automatically accept offers, reprice, relist, order goods, or make another autonomous marketplace decision.

You are responsible for the cards you offer; facts and images you supply; your seller status; and your compliance with marketplace rules, consumer law, product-safety rules, tax, dispatch, returns and buyer obligations. Seek TCG remains responsible for performing its own service with reasonable care and skill. We are not the seller, buyer, auctioneer, payment holder or party to your marketplace transaction.

You may disconnect a marketplace at any time. Disconnection stops future access but may not undo a listing or transaction already sent to the marketplace.

eBay-specific terms

Where the service displays eBay content or acts through an eBay API, you agree to comply with the eBay Developers Program API License Agreement to the extent it applies to you as a Seek TCG user. Any sublicense to display eBay content is limited, non-transferable and revocable. eBay is an intended third-party beneficiary of these eBay-specific terms and may enforce them. Your breach of applicable eBay terms may require us to suspend the relevant feature.

6. Your content and intellectual property

You retain any rights you have in photographs, inventory records, notes and other content you provide. You grant us a non-exclusive, worldwide, royalty-free licence for the duration needed to host, copy, adapt and transmit that content solely to operate, secure and improve the features you request, including AI analysis and a user-confirmed marketplace listing. This licence does not permit model training, advertising use or public gallery use unless you separately and expressly agree.

You confirm that you own or are authorised to use the content and that our permitted use will not violate another person’s rights or law. Owning a physical card does not necessarily mean you own the artwork on it. Do not upload unrelated personal data, unlawful content, counterfeit material or content you are not entitled to use. We may restrict or remove content where reasonably necessary following a substantiated rights complaint or legal duty and will provide notice where lawful and appropriate.

Seek TCG and its software, design and original content belong to us or our licensors. We give you a limited, personal, non-exclusive, non-transferable and revocable right to use the service in accordance with this agreement while your account is active. Third-party card, publisher, marketplace and grading names and data remain subject to their owners’ rights and terms.

7. Acceptable use

You must not:

• use Seek TCG unlawfully, deceptively, abusively or in breach of a connected provider’s rules;
• access another user or marketplace account without authority;
• upload malware, interfere with security, probe for vulnerabilities without written permission or evade limits;
• scrape, bulk-export, resell or build a competing database from Seek TCG or third-party data;
• use Seek TCG to infringe IP rights, sell counterfeit goods, misrepresent authenticity or manipulate prices;
• share OAuth tokens, API credentials or access intended for your account; or
• use automated tools against Seek TCG except through a feature or API we expressly provide for that purpose.

8. Plans, charges and renewal

Before a paid order, we will show the plan features and material limits, billing interval, minimum term, total price inclusive of applicable VAT, any usage/top-up charge, renewal frequency and the date and amount of the next charge. The button used to confirm an order will make the obligation to pay unambiguous. We will promptly provide confirmation and the accepted terms in a durable format you can retain.

A subscription renews automatically for the interval shown at checkout until cancelled. Cancellation stops the next renewal; ordinary access continues to the end of the paid period unless the account is terminated for a serious breach or a statutory withdrawal ends the contract sooner.

Web purchases are billed by Seek TCG using Stripe as our payment processor. Apple in-app purchases are billed and managed through the Apple account used to subscribe. The same account must not hold overlapping web and Apple subscriptions; the product provides purchase restoration and a control intended to prevent duplicates.

Any AI or usage top-ups, and their expiry, carry-over and refund rules, will be stated at purchase. If a payment fails, we may retry it and, after reasonable notice, restrict paid features; we will not charge an undisclosed fee.

9. Trials, plan changes and price changes

Any free or discounted trial will state its length, what it converts to, the conversion date and price, and how to cancel before being charged. There will be no pre-ticked paid add-on.

Before an upgrade or downgrade, we will explain when it takes effect, any immediate charge or credit, new limits and the treatment of stored data. A downgrade will not silently delete data.

We may change a future renewal price only after clear advance notice stating the new price and effective date and providing a simple way to cancel before it applies.

10. Cancellation, withdrawal and refunds

You can cancel future renewal through account settings. Apple subscriptions must also be managed through Apple’s subscription controls. Account deletion and subscription cancellation are separate actions. The Refunds & cancellation policy explains ordinary cancellation, the consumer 14-day cancellation right, proportional charges after a request for early performance, faulty-service remedies and the route for each billing channel.

11. Availability and changes to the service

We may maintain, secure and improve the service and may need to alter or discontinue a feature because of law, security, provider terms or technical change. We do not promise uninterrupted availability. We will use reasonable care, give reasonable notice of a material adverse change where practicable and provide an appropriate remedy where required by consumer law. A change will not retrospectively remove an accrued right or make a paid service materially different without a lawful basis and fair remedy.

12. Suspension and termination

You may stop using Seek TCG and request account closure at any time. We may suspend or terminate access where reasonably necessary for a serious or repeated breach, security risk, unlawful activity, non-payment, provider requirement or discontinuation of the service. Except where urgent action is required, we will give reasonable notice and an opportunity to correct a remediable breach.

We will explain the effect on subscription charges, prepaid fees and data. Where suspension or termination results from our discontinuation rather than your breach, we will provide any refund required by law. We will allow a reasonable opportunity to export data unless prohibited by law, security or third-party rights. Terms that by their nature should continue—including payment accrued, IP ownership, liability, disputes and legal compliance—survive termination.

13. Our responsibility to consumers

We provide the service with the reasonable care and skill required by law. Nothing in these terms excludes or limits liability where it would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the contract was made, for a marketplace’s independent act, or for business losses where you use Seek TCG as a consumer. This does not exclude responsibility where Seek TCG’s own error caused or contributed to the loss. You should give us a reasonable opportunity to correct a faulty service where the law allows.

14. Business users

If you are a business user, no consumer right is created by these terms. Separate business terms (covering warranties, mutual responsibility, indemnities, buyer-data processing, insurance, exclusions and a negotiated aggregate liability cap) apply where we offer them; the consumer protections above are not reduced by this section.

15. Complaints and disputes

Contact hello@seektcg.com or write to us at 2 Ashcombe Road, Merstham, Surrey, RH1 3BY, United Kingdom. We will acknowledge and investigate complaints promptly. This does not restrict your right to contact a regulator, marketplace, card issuer or court.

16. Changes to these terms

We may update these terms for legal, security, technical or service reasons. We will give reasonable advance notice of a material change and explain when it takes effect. If a change materially disadvantages you during a paid period, you may end the affected service and receive any remedy required by law. Merely continuing to use the service will not be treated as agreement to a change where law requires express agreement.

17. Governing law and courts

These terms are governed by the law of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections that apply in the country where you live, and you may bring a claim in any court available to you under applicable consumer law.
