Consumer terms of service

Version 1.0 · effective 19 August 2026. We keep these policies under review and post material changes here.

Seek TCG is in private beta and operates a waitlist; product accounts and paid plans are not yet open. The subscription terms below apply once paid plans launch.

These terms apply when you use Seek TCG mainly outside your trade, business, craft or profession. If you use Seek TCG mainly for business, the Business Terms and Data Processing Schedule apply instead. A profile selection does not override your legal status.

1. Who we are

Seek TCG is currently operated by Benjamin McCarthy-Jones trading as Seek TCG, 2 Ashcombe Road, Merstham, Redhill, RH1 3BY, United Kingdom (we, us, our). Email: hello@seektcg.com.

No incorporated company is the contracting party unless and until one is formed and these terms are expressly updated. We will give advance notice of any proposed transfer of this agreement to an incorporated business and will not reduce your rights by doing so.

These terms, your order summary, the plan description, our Subscription, Cancellation and Refund Policy, Privacy Notice and any marketplace authorisation shown before you connect or publish form our agreement with you.

2. Eligibility and accounts

You must be at least 18. Give accurate information, keep your credentials secure and tell us promptly at hello@seektcg.com if you suspect unauthorised use. You are responsible for actions you authorise; you are not responsible for loss caused by our breach, negligence or insecure operation.

You may use only accounts and marketplace connections you own or are authorised to operate. You must not transfer or share an account without our written permission.

3. What Seek TCG does

Seek TCG helps you identify trading cards, record visible condition evidence, manage inventory, view permitted third-party market information, calculate estimated costs and profit, and prepare listings for connected marketplaces. Available features and limits are those shown for your plan when you order.

Identification, condition, authenticity indicators, price signals, profit figures, tax prompts and sell/bundle/hold suggestions are automated estimates. They can be incomplete, delayed or wrong. They are not certified grading, authentication, a guaranteed sale price, a tax calculation, financial advice or an investment recommendation. Review every result and every listing field before acting. Keep independent copies of important records.

Nothing in these terms reduces our duty to provide the service with reasonable care and skill or any other statutory right.

4. Marketplace connections and your authority

Authentication takes place through the marketplace’s OAuth process. By connecting an account, you authorise us to access only the information and permissions shown in the connection flow and to perform actions you separately request.

Before publishing a listing, we will show the material listing fields, including the item, condition, description, price, quantity, postage, returns and marketplace account, and ask for a separate Publish listing confirmation. Unless a future feature is separately described and enabled by you, we will not automatically accept offers, reprice, relist, buy goods or make another autonomous marketplace decision.

You are responsible for:

• owning or being entitled to sell the goods and use the information and images you provide;
• accurately describing the item and reviewing the generated listing;
• your seller status and compliance with marketplace rules, consumer, product-safety, tax, dispatch, return and buyer obligations; and
• completing the sale and dealing with the buyer.

We remain responsible for carrying out our service with reasonable care and skill. We are not the seller, buyer, auctioneer, payment holder or a party to the sale of your card. Disconnecting a marketplace prevents future access after revocation takes effect but does not reverse an action already sent to the marketplace.

eBay-specific terms

If Seek TCG displays eBay content or acts through an eBay API, you agree to comply with the eBay User Agreement and the eBay Developers Program terms to the extent they lawfully apply to you as a Seek TCG user. Any right to display eBay content is limited, non-transferable and revocable. eBay is an intended third-party beneficiary of this paragraph and may enforce it. We may restrict an eBay feature if required by eBay or its terms.

Seek TCG will not use eBay content to suggest or model a price unless the relevant use has eBay’s required prior written consent. eBay content may be subject to freshness, display, retention and deletion limits.

5. Your content

You keep any rights you have in photographs, inventory records, notes and other content you provide. You grant us a non-exclusive, worldwide, royalty-free licence, for only as long as necessary, to host, copy, adapt and transmit that content solely to:

• provide and secure the features you request;
• send a photograph and relevant card details to the disclosed AI provider for a requested analysis; and
• send a listing you confirm to your chosen marketplace.

This licence does not permit us to use your account content for advertising, a public card gallery or model training. Any materially different use requires a separate, specific and genuinely optional agreement.

You confirm that you own or are authorised to use your content for these purposes and that it is lawful. Owning a physical card does not necessarily mean you own copyright in its artwork. Do not upload unrelated personal information, unlawful material, counterfeit material or content you are not entitled to use.

We may restrict or remove content where reasonably necessary to comply with law, a substantiated rights complaint, a marketplace requirement or security need. We will tell you where lawful and reasonably practicable. Send notice-and-takedown / IP notices to hello@seektcg.com with the work or right, the complained-of material, its location, your contact details, the basis of the complaint and a good-faith accuracy statement.

6. Our intellectual property and independent status

Our software, design and original content belong to us or our licensors. While your account is active, we give you a limited, personal, non-exclusive, non-transferable right to use the service under this agreement.

7. Acceptable use

You must not:

• use Seek TCG unlawfully, deceptively, abusively or in breach of a connected provider’s rules;
• access another user’s or marketplace account without authority;
• upload malware, disrupt security, evade limits or probe systems without written permission;
• scrape, bulk-export, resell or build a competing database from Seek TCG or third-party data;
• infringe rights, sell counterfeit goods, misrepresent authenticity or manipulate markets or prices;
• share OAuth tokens, API keys or account access; or
• automate access except through a feature or API we expressly provide.

8. Plans, prices and renewal

Before you place a paid order, we will show the plan, material features and limits, billing interval, any minimum term, total price including applicable VAT, any usage/top-up charge, renewal frequency, and the next charge date and amount. The order button will make the obligation to pay clear. We will promptly email a confirmation and a copy or durable link to the exact terms you accepted.

Subscriptions renew automatically for the interval shown at checkout until cancelled. Ordinary cancellation stops the next renewal and paid access normally continues to the end of the paid period.

Web purchases are charged by Seek TCG using Stripe. Apple in-app purchases are charged through the Apple account used to subscribe and are also governed by applicable App Store terms. Your Seek TCG account must not hold overlapping web and Apple subscriptions. Use Restore Purchases where relevant and contact us if you see a duplicate.

Any trial will state its length, what it converts to, the conversion date and price, and how to cancel before payment. There are no pre-ticked paid add-ons.

Before an upgrade or downgrade, we will state when it takes effect, any immediate charge or credit, new limits, and what happens to stored data. A downgrade will not silently delete your data. A future renewal price may change only after clear advance notice of the new price and effective date with a simple way to cancel before it applies.

If payment fails, we may retry it, notify you and allow a reasonable period to update payment details before restricting paid features. We will not charge an undisclosed fee.

9. Cancellation, withdrawal and refunds

You may cancel renewal through account settings at any time without a cancellation fee. Apple subscriptions must also be managed through Apple’s subscription controls. Account deletion and subscription cancellation are separate actions; the product must warn you and help you complete both.

If you are a UK consumer, you normally have 14 days from entering the online subscription to cancel without giving a reason. If you ask us to begin the service during that period and then cancel, we may deduct only the proportionate amount disclosed in the Subscription, Cancellation and Refund Policy for service actually supplied before cancellation. We do not ask you to waive the cancellation right merely because access begins immediately.

10. Service availability and changes

We use reasonable care but do not promise uninterrupted availability. We may maintain, secure, improve or alter a feature for legal, security, supplier or technical reasons. We will give reasonable advance notice of a material adverse change where practicable and provide any remedy required by law. A change will not retrospectively remove an accrued right or make a paid service materially different without a lawful basis and fair remedy.

11. Suspension and ending the agreement

You may stop using Seek TCG and request account closure at any time. We may suspend or terminate access where reasonably necessary for a serious or repeated breach, security risk, unlawful activity, non-payment, supplier requirement or discontinuation. Unless urgent action is needed, we will give reasonable notice and an opportunity to correct a remediable breach.

We will explain what happens to your subscription, prepaid amount and data. If we discontinue a paid service for reasons unrelated to your breach, we will provide the refund or other remedy required by law. We will allow a reasonable opportunity to export data unless law, security or third-party rights prevent it.

12. Our responsibility to consumers

We provide the service with the reasonable care and skill required by the Consumer Rights Act 2015. Nothing excludes or limits liability where unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights.

We are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the agreement was made, a marketplace’s independent act, or business losses where you use Seek TCG as a consumer. This does not exclude responsibility where our own error caused or contributed to the loss.

Where law permits, give us a reasonable opportunity to repeat or correct a faulty service. If that cannot be done within a reasonable time and without significant inconvenience, you may be entitled to a price reduction or other remedy.

13. Complaints

Email hello@seektcg.com or write to the address in section 1. Include your account email, the issue, relevant date/charge/listing and the outcome you want. We aim to acknowledge within 2 working days and provide a substantive response within 14 days. Complex matters may take longer; we will explain why and update you.

Nothing restricts your right to contact Citizens Advice, Trading Standards through the appropriate route, a regulator, marketplace, payment provider or court. We do not currently subscribe to a particular consumer ADR scheme; if that changes, we will update this section.

14. Changes to these terms

We may update these terms for legal, security, technical or service reasons. We will give reasonable advance notice of a material change and say when it takes effect. If a change materially disadvantages you during a paid period, you may end the affected service and receive any remedy required by law. Continued use is not treated as agreement where law requires express agreement.

15. Law and courts

These terms are governed by the law of England and Wales. If you live elsewhere as a consumer, this choice does not deprive you of mandatory protections that apply where you live, and you may bring a claim in any court available under applicable consumer law.
